Terms of service
1. Purpose
These terms of service (the "Terms") govern access to the website imagecommerce.net and the use of the related online services published by Perspective GAIA SARL (the "Publisher"). Use of the software installed on your device is governed by the End-User License Agreement (EULA).
2. Acceptance
Accessing the website and using the services constitutes full acceptance of these Terms. If you do not accept them, do not use the website or the services.
3. Service description
Im.Age Commerce is a commerce-management software designed for small merchants. It is primarily offline: business data is stored locally on your device. The website handles downloads, license activation, and update notifications.
4. Account and verification
Some features require verification by OTP sent through WhatsApp Business. You agree to:
- provide accurate information;
- keep access to your verified phone number confidential;
- promptly report any unauthorized use to [email protected].
5. Acceptable use
You agree not to:
- use the service for unlawful purposes or in a way that harms third parties;
- attempt unauthorized access to our systems (intrusion, scanning, denial of service);
- circumvent licensing or protection mechanisms;
- massively extract or copy site content without authorization.
6. Intellectual property
The website, software, architecture, source code, trademarks, and content are protected. No rights are transferred beyond what the EULA expressly grants.
7. Availability
The Publisher endeavors to keep the website available but does not guarantee continuity or freedom from error. Downtime for maintenance, updates, or force majeure may occur.
8. Personal data
Processing of personal data is governed by the Privacy policy.
9. Liability
To the fullest extent permitted by law, the Publisher shall not be liable for indirect damages, lost profits, or data loss resulting from use of the website or software. You remain responsible for regularly backing up your business data.
10. Changes
The Publisher may modify the Terms at any time. The applicable version is the one online on this page at the time of use. Material changes will be announced inside the application.
11. Governing law and jurisdiction
The Terms are governed by the laws of Burkina Faso. Any dispute shall be submitted to the courts of Ouagadougou, except where mandatory law provides otherwise.
